With a SCOTUS Hearing Pending, Siemens Healthineers Employees Continue to Challenge the Vaccine Mandates – Opinion

United States Supreme Court heard arguments against the OSHA vaccination mandates of Biden’s administration for companies with over 100 employees. The same applies to medical facilities that receive Medicare funding and hospitals that are covered by federal funding. After the Sixth Circuit Court of Appeals ruled in favor of the vaccine mandates being allowed to stand, it was obvious that SCOTUS would be elevated. While the high court was currently considering other cases related to vaccine mandates on an emergency basis, it does not normally allow for oral arguments. The court made an extraordinary announcement and scheduled a hearing for January 7, 2022.

That is less than two days away, and legal experts spoke to USA Today, indicating that the odds may not be in Biden’s favor:

“It’s none of my business as an employer to get into the medical decisions of my employees,” said Trosclair, a second-generation grocer and former Republican candidate for state legislative office. “I just thought it was incredibly wrong to put that burden on the employer as well as…on the employee.”

Legal experts predict Trosclair’s argument will resonate with the high court, where conservatives now enjoy a 6-3 advantage. Although the courts have rejected numerous challenges to COVID-19 vaccination mandates by local and state governments, Biden’s administration seems certain to receive a harsher reception.

The harmful seeds of vaccine mandates are already being planted and germinated. They have been growing in the bigger corporations that Biden believed would be doing his bidding. These corporations don’t give a damn about individual civil rights and freedoms. These companies use mandates instead to trim their employees and boost their fiscal bottom lines.

These are the ways Honeywell, Siemens and IBM have worked:

  1. Private companies had already begun to prepare for their own vaccine mandates before Biden announced his executive orders regarding vaccine mandates in his press conference on September 9, 2021.
  2. In forcing their employees to receive vaccinations, the mandates only allowed acceptance of the three emergency use vaccines: Pfizer, Moderna, Johnson & Johnson. The mandates did not allow for natural immunity or health accommodation.
  3. An employee must register his or her vaccination status with a company database. This will force them to divulge their personal information to an unprotected third party.
  4. Emails shared with RedState show that corporations have established their own “COVID-19 Task Force;” however, the corporations refuse to disclose the members who comprise this task force. This task force has the responsibility of deciding who gets an exemption and who doesn’t.
  5. Although some of these companies claimed they would offer accommodations and exemptions for religious or medical reasons, many others simply used this as a way to show their appreciation, or outright reject their requests. Many companies refused to offer accommodations.

We now know the purpose of these mandated vaccines: A Purge.

Whether it is the U.S. Marines (169 service members have been discharged since Christmas Eve) or private industry, this vaccine mandate autocracy is a convenient excuse to get rid of those less… desirable, as well as trim the fat and clear out staff.

Siemens Healthineers is a distinct corporate arm of Siemens AG. It uses the exemption of the vaccine mandate as an excuse to close down the division.

How, you might ask? After my exposés about Siemens, several of Siemens’ employees and contractors reached out to me. A majority of these employees are either remote workers who are not “client-facing,” others are independent contractors where the terms of their agreements clearly outlined that a) they were not “client-facing,” and b) they were not subject to the same provisions as the regular employees: like vaccine mandates.

One former employee said:

I’m a Siemens Healthineers’ employee of 19 years, about to be cut for not submitting to their sick agenda because now I am “dirty.”

While I prefer not to be identified, we were treated by HR like complete crap. They won’t answer our emails or talk with us.  Their responses are like “bots” and statements like, “We care about the health and wellness of our employees.” I cannot verify this, but I was told there are 400 people at our site asking for exemptions, which is a third of our site. Even those with remote jobs, they won’t let them have exemptions.

They peddle a ton of propaganda, have had a few webinars telling us to “get vaccinated,” where they say they aren’t providing medical information, while also stating, “talk to your physician about the vaccine,” and then proceeding to cut anyone with a religious exemption. To put it mildly, they have already made cuts but plan to reduce religious exemptions.

They have already designated this site as “vaccine only.” Anyone that doesn’t get vaccinated will be voluntarily resigned. Their rules have been modified several times, and they’ve given us contradictory information. They are extremely disorganized. They aren’t allowed to test as an accommodation or alternative.

Ophelia, another Siemens Healthineers employee refused to comply. Because she considered the mandate a violation of her civil rights, she refused to enter her vaccine status into the company’s TrueNorth database, and continued to ask questions, demand answers, and defend her right not to be forced to be vaccinated:

Dear Siemens Healthineers USA COVID-19 task force,

We need your information to update the policy.

1. Is it possible to be sure that your medical data will not be leaked into a third-party application?

2. You must provide evidence that Siemens has been identified by the CDC.

3. You must prove that you can prevent, or minimize the future variation of the disease or transmission.

4. If you have any adverse reactions, let us know. We will be happy to help with future treatment.

5. If I accept this treatment, will the Siemens life insurance still apply?

If there has been a standard procedure for Siemens medical treatment for contagious virus infections in the past, please let us know. This was required to treat Influenza, Ebola and Legionnaires.

Ophelia was one the Siemens Healthineers contractors who fell into the mandated vaccine requirements. Even though her contract guidelines stated otherwise, Ophelia reminded every human resource personnel to whom she spoke:

As stated previously, Federal Contractors Guidance in relation to my position and/or department is not included within the new policy, HC–HRS1. The statements highlighted in FAQ’s below are not true. My department is not covered by the actual guidance. Nor does my position as a permanent remote employee. As stated on pages 3 & 4 of the Draft contractor guidance doc_20210922, my department is not party to any covered contracts, and as a fully remote employee, my residence is not considered to be a covered contractor workplace.

It’s amazing how quickly that money can fly out of the window.

Sadly, on December 3, 2021, Ophelia was placed on unpaid suspension, then placed into the ridiculous category of “voluntarily resigned,” before they formally terminated her.

My contract with Siemens was not adhered to and I was dismissed on 17 December 2021. None of the laws that they broke in their new policy were addressed. What are the next steps? Next steps? We will have to use a new approach because the criminal offenses in Delaware seem to be committed by the AG. When I have a plan, I’ll reach out.

Beckie submitted a religious exemption on September. After dealing with back-and forth correspondence between her manager and Human Resources, Beckie received this bizarre concession on October 29th, 2021.

Dear Beckie

We received your request and have reviewed it.

The following conditions have been applied to your request:

Temporarily approved for: January 7, 2022

Fascinating. This is fascinating. This seems like more than an odd coincidence.

The Company may extend approval for requests that are longer than the ones noted. As the approval date nears, the Company will assess whether the request is unreasonable or allow it to be extended.

You are subject to the following safety precautions, based on your exemption request, while visiting a Siemens Healthineers or customer site.

Social Distancing during meals or breaks

The Customer Requires Precautions

 COVID-19 Testing (as determined by federal/state/local/site/customer requirements)

You may also be allowed to work remotely as temporary accommodation.

It is an indication of how companies approach these mandates in a one-size fits all manner. Beckie is a remote employee since 2020 when the pandemic started. She has very little interaction with customers, if any. If a human resource department, or this task force does not know this, how can they make appropriate decisions on an employee’s behalf?

These requirements will apply to you for the entire duration of your exemption, even if they are removed by the Company.

It is up to you, the employee or your requirements of your job, to inform your HRBC about any changes so your exemption can be reviewed.

You may be able to find remote positions that offer accommodation. You can view the current positions here https://usa.healthcare.siemens.com/careers. Send an application to any available remote jobs for which you think you’re qualified. Also, contact your HRBC.

Do these roles seem remote? Beckie noticed the same disconnect. I asked her for her response. She said that:

You should also note that while they claim that you can submit for remote positions in their canned emails, they actually let those with remote jobs go..

Siemens Healthineers then issued the following caveat regarding religious accommodation

The Company reserves the right to reassess the accommodation and whether it’s creating an undue hardship at any time.

Beckie informed my about a couple of days ago that the exemption had been extended to March.

Siemens sent me an email on Friday, 17th to inform me I have been temporarily approved once more and that my approval will continue until March. They will continue to torture and abuse me. There has been nothing new that I know of. The most recent was the fact that they weren’t backing down in spite of what was happening. As of Wednesday 13 December, that was..

Beckie is still required to “show her papers” by documenting her status in the TrueNorth database.

Siemens Healthineers Human Resources

The goal is to answer the questions of “who will comply” and “who will not comply”. Our government has no plan of relinquishing the controls they gained over Americans during this pandemic, so they want to know which Americans were the ones who chose to bend, and which ones didn’t. Zweiten, Siemens Healthineers has an army of willing employees that they can manipulate to get more compliance.

OSHA’s co-chair stated the following:

John S. Ho, co-chair of OSHA-Workplace Safety Practice at Cozen O’Connor, said that companies should be developing a “roster of vaccination status” of employees to show OSHA “good faith” in complying with the mandates.

“You should have that roster in place by Jan. 10,” he said. But Ho also is advising companies to take a “wait-and-see approach” on implementing the vaccination mandates that could lead some employees to quit.

While SCOTUS can be a strong supporter of the Constitution and civil liberties, revenue loss is what these companies understand, with a great deal of public shame.

Because it required the unilateral modification of federal contracts’ terms and conditions, this order proved to be problematic. Negotiations are required for contract modifications that affect contractor costs or staffing. Contract mods that call into question the ability of some contractors to complete their contracts definitely can’t be imposed by the government. That was becoming the case as major federal contractors like Huntington Ingalls Industries, the major U.S. Navy shipbuilding company, suspended the vaccine on mandate on its own authority. Raytheon and General Electric have warned of losing “several thousand” employees should that unconscionable mandate be enforced.

Employees staged protests and walkouts at other companies in response to the mandate.

OSHA’s Ho knows this, which is why he is dependent on these company databases of compliant individuals to continue this twisted slide into fascism.

Many Siemens Healthineers joined forces with Liberty Counsel and other legal entities that allow free speech to keep them from being sued in class actions. These companies won’t understand the loss of history, experienced employees or litigation costs.

Streiff made some great points about the actions corporations have taken, at our peril, as well as what we can do to prevent them from doing so again.

First, it is against the law for corporations to require any treatment or therapy from their employees. We all stood idly by when companies banned smoking and imposed “wellness” programs on their employees; now, we are reaping the fruits of our inaction. The corporations are the primary and willing enforcers for this Mengeleian regulation. They must be disabused of the notion that their employees are their property (see OSHA’s Suspension of Implementation and Enforcement of the Vaccine Mandate Means Nothing Unless Corporations Also Stop). We must take legal action against corporations that impose medical requirements on any person. Secondly, so long as we are ruled by the lawless and unethical bunch in the White House, mere court injunctions are irrelevant (see The Fifth Circuit Slapping Down Biden’s Illegal Vaccine Mandate Is Meaningless in the Face of a Lawless Presidency). Biden, for his part, has made it clear that he instructed businesses to ignore any court orders and instead use theirs.

It is hoped that all the employees of Siemens Healthineers, as well as other large corporations who are fighting back, will prevail. The Biden administration is playing a dangerous game with people’s lives, and he might not know it now, but it is going to blow up in his face.

It has already done so in many different ways.
