During their manic Monday defense of Judge Ketanji Brown Jackson from extra scrutiny of her record regarding an apparent leniency with sex crimes on ABC’s The View, the cackling coven decided to falsely claim that Justices Clarence Thomas and Brett Kavanaugh were “credibly accused” of sexual misconduct. Because of this smear, co-host Sunny Hostin was forced to deliver a “legal note” announcing that both Justices deny the LIES spewed against them.
After noting that Senate Minority Leader Mitch McConnell (R-KY) hoped Jackson would be treated better than Thomas and Kavanaugh were, rotational co-host and unhinged anti-Trumper Ana Navarro said she found it “interesting” that he decided to mention the justices “who happen to be two who were accused of sexual harassment and sexual assault. So yes, I hope she gets treated differently than people who have been credibly accused of that.”
And at the end of the segment, Hostin was forced by their ABC standards and practices representative to issue their denials of the false accusations against them, much to Navarro’s voiced chagrin:
HOSTIN (And I have a quick legal notice, it is that Justice Brett Kavanaugh of the Supreme Court and Justice Clarence Thomas both have denied any allegation regarding sexual misconduct.
NAVARRO : They did.
The accusation wasn’t true in reality. They were actually unable to prove their claims after FBI and Judiciary Committee investigations.
Navarro asked that Jackson be confirmed by Republican senators because she is of color.
People need to keep in mind the historic aspect. The court was established in 1789. This is 234 years ago. It will be the first time that a black woman is seated there. Joe Biden said it is a BFD.
Hostin, ignoring the fact that Kavanaugh was in front of this committee several times before his lies were spread, suggested that the Senator Josh Hawley’s new scrutiny regarding Jackson’s rulings with regard to sex crime and child porn records was unique to Jackson. “poison the well”:
[S]He had already been through the process three times, so there was nothing new. It seems they just waited to get started, you know poisoning the water and making it murky.This was not surprising.
Hostin claimed that Jackson was soft on criminals, but Hostin did not have any evidence. “not true.”Jackson was further protected by her brushing aside sentencing guidelines as “advisory” “at this point,” “they’re just guidelines.”
Sara Haines, ignoring the fact that certain cases involved child pornography production, destruction and consumption, claimed the case was about the “consensual relationship” in high school between “an 18-year-old kid maybe” and “a 17-year-old.”Then, she suggested that Hawley was playing to conspiracy theorist fringes.
“She’s unassailable,”Hostin and Haines declared unison. Adding: “[A]It will, I believe, be as rigorous and thorough as it ought to. This is a lifetime appointment, but she is more qualified than so many people.”
For co-host Whoopi, it was all about racism. Jackson’s thoughts about racism were sparked by her suggestion. “special empathy for criminals” was “code” for “she may be sympathetic to black people.”
Goldberg also omitted Jackson’s time as a private defender of Guantanamo Bay terrorists as she noted Jackson’s time working for them as a public defender.

WHOOPI GOLDBERG [in a mocking accent]: Let me just ask one question. Are you sure she will be scrutinized more than Barrett and Kavanaugh? It is possible.
SUNNY HOTIN: Given the allegations, Kavanaugh went through a very complex process. His process was rigorous and very robust. Amy Coney Barrett says that this justice process wasn’t as strict because it was not as time-sensitive. We know from the Democratic Party how problematic the timing of the proceedings were. So her process, I believe, wasn’t quite as thorough.
This is not surprising to me, but I am just — You know what? Republicans were hedging their wagers. She had been through the process three times, so she knew they would vote. So I believe they just waited to poison the well and make it murky. As was to be expected.
ANA NAVARRO : Oh, well. I find it interesting that two of the judges — Justices Mitch McConnell and Clarence Thomas — have stated that they hope she is treated differently. They were both accused of sexual harassment or assault. Yes, she should be treated differently from those who are credibly charged with that.
I wish she is treated the same way Gorsuch was, as Barrett, which means that you have an intense and carefully scrutinized process, where her judicial philosophy, qualifications, and record are scrutinized. Once you are in, this is an appointment that lasts a lifetime with little accountability.
HOSTIN: That’s true.

HOSTIN – I would like to add my opinion on the sentencing guidelines. Josh Hawley has been claiming that Josh Hawley made it easy for child sex offenders or child traffickers. That is not true.
GOLDBERG – And nobody noticed.
HOSTIN: No one has noticed this before. And it’s just not true. I followed the federal sentencing guidelines, and practiced in the areas of child trafficking and sex crimes. These sentencing guidelines, at this stage, are advisory. They are guidelines.
Back in the day when I began practicing, it was definitely like this: If those were the guidelines it removed the discretion from judges and you had to follow them. Now, it’s different they’re advisory only. It’s okay to recommend, for certain situations, that they aren’t guidelines. In two-thirds of cases, it happens.
SARA HAINES: It’s common among – there’s some debates right now as to how we fix these laws. Because you’ve got an 18-year-old kid maybe in a consensual relationship with a 17-year-old, that becomes a sex offender. There are some reasonable reasons for this, and it does sound great in a Hawley title. But, I suggest you look at the source because every QAnon plot known to mankind begins with pedophilia. There is always at least one pedophile in the mix.
So, right when I saw it I was like, “wow, he’s not even trying to veer from the textbook of accusation here.”
This is an issue that judges often discuss and that you can verify.
HOSTIN: Yes.
HAINES – Many are saying that the way things have been done is wrong. They are now pursuing reforms in criminal justice. The left went after, you know, Amy Coney Barrett’s – a concern about whether her religious beliefs would play into her legal jurisdiction. This makes it clear that reforms in criminal justice will get the right. Because this woman is such, I believe that they must do it because that is the only way to go.
HOSTIN: She’s unassailable.
HAINES: She is unassailable and it will be as rigorous as it should. She is qualified and well-qualified for these lifetime positions.

GOLDBERG She didn’t seek out representing Guantanamo prisoners. All four of her cases were assigned to her as federal public defense from 2005 through 2007. While her brother was serving as an Army infantryman, she served in the United States.
It makes me wonder too, as Mitch McConnell claims that her supporters can see her resume and draw a special empathy to criminals. It sounds code, even though I am sure you aren’t referring to it.
HAINES: Her family is law-enforcement.
GOLDBERG: It doesn’t really matter. Listen. Listen.
HAINES – This is the job when you’re a federal Public Defender.

It is code and it tells you that she may sympathize with black people. Sorry, I know. Clarence Thomas is not one of those people.
