The 9th Circuit Court of Appeals Rules Calif.’s Ban on Semi-Automatic Weapons Sales to Those Under 21 Unconstitutional – Opinion

A U.S. appeals court ruled Wednesday that California’s ban on the sale of semiautomatic weapons to adults under 21 is unconstitutional.

A panel from the 9th U.S., San Francisco, decided in a unanimous 2-1 decision. Circuit Court of Appeals said Wednesday the law violates the 2nd Amendment right to bear arms and a San Diego judge should have blocked what it called “an almost total ban on semiautomatic centerfire rifles” for young adults. “America would not exist without the heroism of the young adults who fought and died in our revolutionary army,” Judge Ryan Nelson wrote. “Today we reaffirm that our Constitution still protects the right that enabled their sacrifice: the right of young adults to keep and bear arms.”

There’s something happening here. The truth is quite simple. The 9th Circuit has become less circus-like and is more of a court. Two judges who were with the majority of cases were ex-President Donald Trump and Mitch McConnell, then-Senate Majority Leader.

The Firearms Policy Coalition brought the lawsuit. According to the AP, they aim to eliminate age-based gun bans state-by-state.

It sounds familiar. It is impossible to overstate the effectiveness of federal laws being dissolved.

This ruling only lifted the requirement that firearms purchases be made by people under 21 years of age. The Firearms Policy Coalition lawsuit also sought to block the state’s requirement of a hunting license for purchases of rifles or shotguns by those under 21-years of age who are not in the military or law enforcement. After a series of mass shootings including that at Parkland in Florida, this requirement was adopted.

The court chose to uphold that requirement as reasonable for increased public safety through, “sensible firearm control.” The court also upheld the California 2019 law that banned the sale of semiautomatic centerfire rifles to anyone under 21.

As crime rages throughout the entire state at the hands of people who could not care less about gun laws and gun bans, law-abiding gun owners have to mount these lawsuits to push back against a government who claims it wants to protect California’s “commonsense gun laws.” Even though these laws have served no purpose in stopping mass shootings. Even in California, the laws are being rescinded because they have been so progressive.

Anthony Portantino (State Senator) was the genius behind these laws. He said that he.

“remain committed to keeping deadly weapons out of the wrong hands. Student safety on our campuses is something we should all rally behind and sensible gun control is part of that solution.”
