According to the acting job anchor Lester “Fairness cannot be overrated” Holt and national correspondent Gabe Gutierrez were putting on, it was just a bland day in the courtroom. “In Kenosha, Wisconsin still no verdict tonight in the homicide trial of Kyle Rittenhouse. Gabe Gutierrez, our Gabe Gutierrez, is present. And the judge sending the jury home after a third day of deliberations, Gabe,” Holt announced.
And for Gutierrez’s perspective and retelling, all the interesting happenings were going on OUTSIDE the courthouse: “Today, once again, a small group of demonstrators gathered outside the courthouse here. Several schools in Kenosha have closed and switched to virtual learning in anticipation of a possible verdict.”
Now to be fair, since he’s banned from entering the courthouse, Gutierrez wasn’t in the room to see it and that’s all he had to look at.
While CBS Evening News also omitted the NBC family’s folly, ABC’s World News TonightTheir competitor was embarrassed. “And today, the judge calling lawyers and Rittenhouse into the courtroom for what he called ‘a very serious matter.’ The judge then revealing he was banning a cable news network from the building,” hyped anchor David Muir.
Senior national correspondent Terry Moran kept up the pressure, reporting: “But outside the presence of the jury today, a shocking moment in court.”
Moran provided a detailed account of the process James G. Morrison used to track down jurors, in addition to soundbites from Judge Bruce Schroeder pointing out NBC/MSNBC.
SCHROEDER – I have directed that nobody from MSNBC News will be allowed in the building during this trial.
MORAN: A judge exempts MSNBC from trial. Kenosha Police claim that they arrested a member of the network’s staff. The man ran a red light next to the bus that was designated for jurors, and claimed that he had been instructed.
SCHROEDER: That is a very – that’s extremely serious matter.
The Judge also said the matter was “referred to the proper authorities for further action.”
Now for those who would argue that NBC and MSNBC were different organizations, the fact of the matter is, they’re not. Many of the same people, including journalists and support personnel, are shared by both NBC and MSNBC.
In fact, it was NBC News that issued the company’s response, which Moran read from: “NBC News issued a statement, saying, ‘The freelancer never contacted or intended to contact the jurors during deliberations and never photographed or intended to photograph them.’ Adding: ‘We regret the incident.’”
NewsBusters has previously reported that the incident occurred the same night. NBC Nightly News via Gutierrez edited out Schroeder’s scathing rebuke of the media’s “grossly irresponsible handling of what comes out of this trial.”

And today, the judge calling lawyers and Rittenhouse into the courtroom for what he called “a very serious matter.” The judge then revealing he was banning a cable news network from the building. TERYMORAN: This evening, the third and final day of lengthy deliberations have come to an end. Kyle Rittenhouse was charged last year with the murders of two men, and with injuring another with an AR-15 rifle. Jurors are still trying to decide his fate. Rittenhouse claims he acted in self defense.
However, the shocking incident in court today was not witnessed by the jury.
JUDGE BRUCE SCHROEDER : For the duration of this trial, no person from MSNBC will be allowed to enter this building.

Since the start of deliberations, this jury has been working tirelessly. Each juror has been requested to receive a copy. It was taken home by one of the jurors to be studied tonight. The jurors have also seen a large portion of the video evidence together. But today, no questions, no requests for evidence. They’re arguing it out. David?

Eastern, 7:04:38LESTER HOLT – There’s still no verdict at Kenosha in tonight’s homicide case against Kyle Rittenhouse. Gabe Gutierrez will be there. Gabe was sent home by the judge after three days of deliberations.
GABE GUTIERREZ : Yes, Lester. For 23 hours, the jury has been deliberating. There is no sign that they are close to making a decision, or if this might be a dead jury.
A small number of protestors gathered today outside this courthouse. In anticipation of the possible verdict, several schools in Kenosha closed down and moved to virtual learning.
Rittenhouse is facing five felonies for killing and wounding two men during unrest in Kenosha, last year. According to Rittenhouse, he was acting in self-defense.
This case was already being heard by the jury. The defense also requested that the judge declare a mistrial. Lester, there is no ruling.
