Since the Dobbs decision overturned Roe, the Biden administration has been trying to think of ways to force abortions on states that don’t want them. One such attempt in Texas was stopped by a federal judge, the report states. Washington Times.
Biden’s Health and Human Services Dept., “citing the Emergency Medical Treatment and Labor Act — ordered emergency room doctors to perform abortions when necessary.” The move drew legal suits from Pro-Life Obstetricians and Gynecologists and the Christian Medical and Dental Associations, represented by Alliance Defending Freedom.
According to Times:
Trump appointee Judge James Wesley Hendrix noted in his 67 page order that Texas allows abortions for life-threatening situations and the termination of an ectopic child. HHS had issued guidance but did not comply with federal law. The guidelines were subject to public comments and notice.
In a resounding slap, the judge said “That Guidance goes well beyond EMTALA’s text, which protects both mothers and unborn children, is silent as to abortion, and preempts state law only when the two directly conflict.” Accordingly, he issued an injunction blocking the HHS order in Texas while the litigation is pending.
A few Lonestar children will still be safe from the abortion industry. For a while at least.
