CNN, MSNBC Cheer Newsom Going After Guns to Spite Supreme Court on Abortion

California Governor Gavin Newsom, a reenergized after his recall election victory, is now trying to outdo Texas by passing an anti gun law. The law is inspired from Texas’ SB8 anti-abortion statute. He wants to allow private citizens in California to sue anyone selling or manufacturing “assault weapons.”

This weekend’s news was celebrated by the media on CNN and MSNBC. 

Continue reading CNN Newsroom with Fredericka Whifield, the host brought on California Democrat congresswoman Jackie Speier to praise the governor and bash the Supreme Court’s decision in the SB8 case, Whole Woman’s Health v. Jackson.

Announcing that the state was now an “abortion sanctuary” the CNN host touted how Speier once defended partial birth abortion, relaying her own experience in 2011: “Officials in your state say they plan to make California a sanctuary for abortion rights if the U.S. Supreme Court overturns “Roe V. Wade.” You got really personal with America when you spoke about your own abortion on the house floor.” She then played that clip of the Democrat scolding her GOP colleagues.

Whitfield later lamented the fact that the country was moving backwards. 

This was ten year ago. We are listening now to your attempts to ignore many circumstances. I mean, is this nation, in your view, going backwards?” She asked.

 

Her Democrat guest completely agreed, bashing the Supreme Court for taking away the “personal private” right to take another human being’s life in abortion. The CNN host worried for women outside of California: “What’s your message to women outside of California, you know who are waiting to hear what becomes of abortion rights across the country but particularly in their states?” she pleaded to her guest, who again boasted how her state would welcome women to get abortions for any reason.

Another hour of CNN Newsroom with Jim Acosta, fill-in host Phil Mattingly also hyped Newsom’s proposed law: 

He had an idea. A similar principle could be used to create a law. It would allow residents to sue those involved in the manufacture and distribution of firearms. He tweeted, “SCOTUS is allowing private citizens in Texas sue to stop abortion?! If that’s the precedent then we’ll let Californians sue those who put ghost guns and assault weapons on our streets. If Texas can ban abortion and endanger lives, California can ban deadly weapons of war and save lives.”

His guest, PBS host and CNN commentator Margaret Hoover, begrudgingly noted that it didn’t seem within Newsom’s power to make a unilateral law like this. But she tried to soften the blow by insisting Newsom’s political stunt “made a point:”

It seems half-cute. He’s making a point and I can understand his reasoning. However, the law in Texas is the same as the law in Mississippi. These laws have been passed by the legislature and are now in the hands of the governor. This is why I doubt Governor Newsom could do this unilaterally. He’s making an attempt to prove a point. To prove that there is an unfair standard, he uses you know the preposterous vigilante legislations and enforcement mechanisms. Although I can understand his motivations, it just seems too cute. 

John Avlon was her husband and a CNN commentator. He lectured the Supreme Court.

“Well, at the very least it may force some justices to think about the underlying principle and precedent rather than just the ideological desire they may have to see the law in one state passed and not the other,” Mattingly accepted his wish.

On left-wing MSNBC, host Alex Witt was excited by Newsom’s stunt. Bringing on Speier, she gushed, “Wow!” over the governor using the same tactic that the media slammed as “vigilantism” when it came to abortion. As Speier praised the “brilliant” suggestion by her fellow Democrat, Witt raved “if it’s good for the goose it’s good for the gander.”

But constitutional scholar Jonathan Turley deflated the media’s hopes and dreams, writing Sunday to not believe the media hype because the law Newsom is proposing is unconstitutional, as he also deemed the Texas law.

“With his bravado, Newsom has guaranteed that courts will strike down his law as an open ‘mockery’ of gun rights precedent and he will actually box in liberal judges and jurists in voting against the California law on the same grounds”

The governor’s office tweeted a statement writing, “if states can shield their laws from review by federal courts, then California will use that authority to help protect lives. We will work to create the ability for private citizens to sue anyone who manufacturers, distributes, or sells an assault weapon or ghost gun kit or parts in California.” Joining me now is California congresswoman Jackie Speier, a democratic member of the house armed services, intelligence, and oversight committees. 

Wow! And I’m glad to have you. Please tell me what you think about Gavin Newsom’s comments. What Texas has done here is what we’re going use. 

California permits you to make, sell and do everything with ghost guns kits or assault weapons. You can expect us to bring you suit. 

REP. JACKIE SPEIER: Well, it’s brilliant and it makes the point that the Supreme Court absolutely refused to do what it should have done, which is to strike down the decision– that allowed SB8, Texas has given vigilantes the right to sue women who help them get abortions. Texas law is incompatible with the Constitution. It should’ve been struck down by the court. It wasn’t, it was allowed to stay in effect. Justice Sotomayor made it very clear that this was a terrible action for the supreme courts. So if it’s good for the goose its good for the gander and I applaud Governor Newsom for taking that particular point of view. 

WITT: I was going to say that, if it’s good for the goose it’s good for the gander. It’s a similar thought.

FREDRICKA WHITFIELD : OK. I have a question for you regarding a contentious issue within your state. If the U.S. Supreme Court upholds Roe V., officials in California say that they will make California a sanctuary state for abortion rights. Wade.” When you discussed your abortion experience on the floor, it was very personal. It was a topic you discussed ten years ago. I’d like to bring that up for the viewers.

JACKIE SPEIER:  You know, I had really planned to speak about something else, but the gentleman from New Jersey has just put my stomach in knots because I’m one of those women he spoke about just now. A 17-week-old baby that moved from the vagina to the cervix was my experience. That procedure you are about, however, was one that I did. But I did lose a baby.This is an unusual procedure, which is often either accepted or performed with cavalierry or without thought. 

WHITFIELD:  This was ten year ago. We are listening now to your attempts to ignore many circumstances. What do you mean? Is this nation going backwards, according to your perspective? 

SPEIER: No question. Fredericka: I find it deeply disturbing that the Supreme Court has been politicized to the point that Texas’ law can be preserved. However, they know it is unconstitutional and gave license to bounty hunters to sue around Texas. 

California’s current situation is that we will be providing a safe haven for women in order to decide whether they want to have children. This decision should not be taken alone. It must be discussed with the family as well as your doctor. California is going to be a sanctuary. But the governor has gone even further and said, if you’re going to allow this, Supreme Court, we’re going to pass a law in California that’s going to allow people to file lawsuits against anyone who distributes or manufactures assault weapons and brings them in to California — you can so how this is a very slippery slope, and the Supreme Court has done a great injustice to the American people and to the Constitution by take the — taking the position that it has on this particular case in Texas. 

WHITFIELD – What is your message to Californian women who know other states that are eager to learn about the status of abortion rights in America? 

SPEIER: I want to tell women that we will be there for them. You will always have our backs. You can contact us if you have been a victim to rape, incest, or any other type of sexual assault. You can also come to California if your pregnancy was not intended.You can rest assured that we will look after you. 

 It goes really to the core values that we have as Americans. Separate churches and states are possible. And we have a law that’s been on the books for over 50 years that says this is a right of privacy. It is an individual right to privacy. This is unacceptable. And of course there’s no discussion about the impregenator and what their responsibility is in all that. So I have ideas of what I’m going to do next year in terms of introducing legislation to create some responsibility for those who impregnate women who are then forced to have a child.

GUN MATTINGLY: The California governor Gavin Newsom wants gun legislation that is modeled after the controversial Texas abortion law. That’s right. Newsom claims he was angered Friday’s Supreme Court decision that allows private citizens to sue Texas abortion professionals. He had an idea. A similar principle could be used to create a law. It would allow residents to sue those involved in the manufacture and distribution of firearms. He tweeted, “ SCOTUS is allowing private citizens in Texas sue to stop abortion?! If that’s the precedent then we’ll let Californians sue those who put ghost guns and assault weapons on our streets. If Texas can ban abortion and endanger lives, California can ban deadly weapons of war and save lives.”

The governor is asking for $10,000 in damages per offense. John Avlon (CNN senior political analyst) is joining me to discuss the CNN host, Margaret Hoover, who also hosts PBS Firing Line.

Margaret Margaret It seems that there were two Supreme Court justices, who believed something similar would happen after the Texas law. How do you feel about Governor Newsom’s actions here? 

MARGARET HOOVER: Yeah and let’s just be clear, their last names were not Alito or Thomas. [laughter]It seems half-cute. He’s making a point and I can understand his reasoning. That law in Texas is different from the one in Mississippi. These are laws that were passed by the governor and have been sent to the legislature. It’s not possible for governor Newsom to do it unilaterally, so I am unsure. He’s making an attempt to prove a point. He’s using these ridiculous vigilante laws and enforcement mechanisms to show that there is a double standard. Although I can understand his motivations, it just seems too cute. 

JOHN AVLON : It may at least force justices to consider the underlying principle, precedent and other factors than their ideological desires to have the law passed in each state. We’ll see. 

MATTINGLY: I believe that’s more important than the policy. But we’ll see. This point is just the beginning.
