Where He Yet Again Tells Us to Shut The Heck Up (STHU) – Opinion

Joe Biden has spent all of his tenure telling us to “Shut The Heck Up” (STHU).  Tonight’s State of the Union (SOTU) will be nothing different.

Biden will yet again lay out his ongoing, rolling, awful agenda — with which We the Victims have time and again said we want nothing to do.  His policies are terrible — and rank WAY down the priority list We the Victims have compiled.

Except Biden doesn’t care.  He wasted all of 2020 trying to shove down our throats the exceedingly-awful-climate-change-atrocity that is Build Back Never — oops, I mean Better — while helpful, bipartisan legislation perpetually languished in Congressional purgatory.

The slim-Democrat-majority Congress has proven to be mostly inert (thank goodness).  And thanks to Biden and his Democrats totally ignoring us — is likely to become a Democrat-minority Congress in November.

Biden will be more dependent on unilateral, unconstitutional power grabs and policy modifications made by bureaucrats of the Executive Branch.  Without having the opportunity to access any prior Legislative Branch legislation.

In our governmental system (we’re a Constitutional republic — not a democracy), bureaucrats aren’t supposed to do something unless and until our elected Congress passes a law telling them to do it.  Oh, and the Chief Executive issuing Fiat Executive Orders to substitute Legislative Branch legislation is also unconstitutional.

Why would Biden or his Administration not adhere to the Constitution, you ask?  Why not start right now?

To wit: Here’s the woefully misnamed Department of Justice (DoJ) proposing a HUGE policy change on “Licensing Negotiations and Remedies for Standards-Essential Patents Subject to F/RAND Commitments.”  Has Congress — with legislation — authorized this?  Heavens no.

Without getting too into the technological weeds….

What is a Standard Essential Patent and what do I need to know about them?:

“When you woke up this morning, you probably unplugged your cell phone from its charger, looked at it, and saw a Wi-Fi icon at the top. Perhaps you watched some clips on the news while eating breakfast. In a matter of seconds, multiple technologies are used without you even realizing it. This is because hundreds upon hundreds standard essential patents (or SEPs) were involved in your everyday actions.

“Broadly speaking, a standard is a document or a technology that is defined by a standards body in a standard-setting process. Industry representatives often work over years to reach a consensus about a technology. Standards can be the result of many meetings. Although these companies work independently to create their technology, the common goal is interoperability.

“Some commonly-known standards are USB, LTE, Wi-Fi, and others. To ensure that you can use any USB cable purchased from any manufacturer with no problems, standards were created. These standards are not only the most well-known, but there are also many other standards that we use every day, such as video compression standards.

“A standard essential patent starts out as a typical patent and becomes essential to a given standard usually when it is declared to be essential by one of the contributing participants of the standard. As part of the standard-setting process, and sometimes as part of the process of declaring a patent to be essential to the standard, the contributors of a technology who own patents on the technology agree to license the patent on fair, reasonable, and non-discriminatory terms, sometimes abbreviated as FRAND.”

These patents and standards are essential to making our ever-increasingly-technological economy function.  So, of course, Biden’s DoJ is looking to undermine all of it.

Because why wouldn’t Biden want to help China?

There are still some who support us.  They vehemently oppose Biden’s attempt to undermine the US economy in general.

These two fine joints — and several others — filed these statements as Comments as a part of the DoJ’s Comment Period.  Unfortunately….

Bureaucracy Power Grab Comment Periods Are Always Stupid – and Often Corrupt:

“Where some agency of which you’ve probably never heard – and to whom you’ve elected no one – quietly announces a period where you can file thoughts on the damage they’re about to inflict upon you.

“Of course, the Comment Period is entirely and solely Democracy Theater.  (Again, we’re a republic, not a democracy.)  Again, if the government wants to do something new – the process has to begin with legislation by the Legislative Branch.  This is not the Executive Branch’s bureaucratic fiats.

“The Comment Periods – are just dumb. Again, these bureaucrats aren’t elected. And they are under no obligation whatsoever to have the comments you file – affect at all what they’re about to do to you.

“If the comments favor the power grab they are about to execute – they trumpet the results, and move forward as planned. If the comments oppose – they ignore the results, and move forward as planned.”

Biden hopes to assist China and Big Tech in stealing our IP.

No matter what you may think, Biden will most likely continue to help China and Big Tech take our IP.

Because he’s not on our side.

All of these points should be remembered tonight.  As Biden delivers his SOTU — in which he will yet again tell us to STHU.
