Horrified Teen Girl Files Federal Lawsuit After Noticing Transgender Student’s Penis in Locker Room

“When I knew that a man was looking at me, I felt very violated and very scared.”

A controversy regarding whose civil rights should take precedence was sparked last week when a teenage girl alleged in a federal complaint that she was sexually harassed and her privacy was violated by the presence of a transgender student in the same school locker room.

Attorneys for the Honesdale High School student filed a complaint with the U.S. Department of Education’s Civil Rights Division last Thursday regarding an incident that took place in September when she found herself in the locker room with the transgender student.

In a video shared to Facebook by the Law Office of Andrew H. Shaw, the girl described the incident, saying she turned around after hearing a “man’s voice” while she was changing.

“I glanced down and could tell that he was wearing women’s underwear and what was underneath it,” she said. “When I knew that a man was looking at me, I felt very violated and very scared – especially looking at me while I’m getting dressed.”

According to the video’s YouTube description, the transgender student was wearing “revealing female underwear.”

“Opening up restrooms and locker room facilities to members of the opposite sex is sexual harassment, and like many forms of sexual harassment the girls in this school have little power over their situation,” Andrea Shaw, the lawyer representing the female student, said in the video.

According to Shaw, the school’s solution for her client “was for her to wait outside the locker room until the individual of the opposite sex was finished changing.” This caused the student to be late to gym class and her second period class, Shaw said.

“The privacy rights of these girls don’t change because of what a male believes about their gender,” Shaw, who said that the school’s response indicated they felt her client was the problem, added.

Wayne Highlands superintendent Gregory Frigoletto told local ABC affiliate WNEP that the school district’s policy complies with a recent court decision that stipulates trans students are allowed to use the locker rooms of their choice.

“There should be a policy because all students have rights. We have to be sensitive and make sure those rights aren’t violated,” one local resident told WNEP.

“I don’t think there’s anything wrong with someone who identifies as a woman changing in the women’s locker room because that’s how they feel, that shouldn’t be judged, I don’t think they’re trying to be sexual or harass anyone by doing that. I think that’s their right,” said another local resident interviewed by WNEP.

The female student’s case throws a wrinkle into the current cultural debate over transgenderism, which is dominated largely by LGBT activists pushing for the civil rights of trans individuals. Her case reverses that trend by framing the transgender debate as a collision of individual rights, rather than the oppression of one group by another.
