Before being picked up by ICE, Rosiane Santos was charged with disorderly conduct and assault and battery related to the attack, which took place at a Mexican restaurant in Falmouth, Massachusetts. The 41-year-old Falmouth resident is currently in ICE custody, Boston 25 News reported Tuesday.

“Deportation officers with ICE’s Fugitive Operations Team arrested Rosiane Santos, an unlawfully present citizen of Brazil,” ICE officials said in a statement sent to Boston 25.

According to the victim of the assault, 23-year-old Bryton Turner, an agitated Santos began yelling at him after noticing his “MAGA” hat. Turner pulled out his cellphone camera and began recording.

A bartender at the restaurant told Boston 25 that Turner “just walked in and ordered his food” and did not provoke the attack. Santos, who admitted to having had some drinks, claimed otherwise. “I had a little bit to drink, maybe that’s the reason that I couldn’t walk away, but being discriminated for so many times in my life, I just had to stand up for myself,” she said. “He’s not a victim. I am the victim. I have been bullied, OK?”

According to police, Santos told them that Turner should not be allowed to eat in a Mexican restaurant because he supported the president and Trump is planning to build a wall across the US-Mexico border.
